The Contentious-Administrative Chamber of the Superior Court of Justice of the Canary Islands (TSJC) has endorsed the decision of the Government of the Canary Islands to reject the processing of an aggregate extraction project in the municipality of La Oliva, in Fuerteventura. The court has dismissed the appeal presented by the company Arenera Góngora Gutiérrez, which sought to initiate the environmental impact assessment procedure for a project called “Modified and Improvement of the exploitation of calcareous sands”, corresponding to the quarry located in the Barranco de Los Encantados. The ruling confirms the resolution adopted in 2022 by the Vice-Ministry of Fight against Climate Change and Ecological Transition, which decided not to admit the start of the environmental evaluation considering that the project had already been previously analyzed and had received an unfavorable environmental impact declaration in 2019. A project considered “substantially the same” According to the judicial resolution, although the company presented a modification of the project, the court concludes that it is an initiative “substantially analogous” to the previous one. Protected area and habitat of the houbara The area where the exploitation was proposed is located on rustic land with high natural value, within the Lajares, Esquinzo and Costa del Jarubio Special Protection Area for Birds (SPA), integrated into the Natura 2000 Network. In addition, the area is part of the Fuerteventura Biosphere Reserve and is identified as the habitat of the houbara, an emblematic species of the island whose population has been affected, among other factors, by sand extraction. The court also highlights that the project did not have favorable reports from the Fuerteventura Town Council or the Biosphere Reserve Council, nor did it have specific studies on its impact on this protected species. Possible appeal to the Supreme Court With this decision, the TSJC confirms the legality of the administrative resolution that stopped the extractive initiative. The development company could still file an appeal before the Supreme Court if it proves cassational interest. The ruling represents, for the moment, new judicial support for the environmental protection of the area where mining exploitation was proposed.
