In a recent development in Puerto del Rosario, Ana Hernández, the councilor overseeing Urbanism, shed light on the controversial situation surrounding the Bar-Cafeteria service located in Plaza Millares Sall. This establishment came under scrutiny after its concession was awarded to Grupo VIP Fuerteventura, represented by Álvaro Sanz, through a negotiated procedure without public announcement in 2022, following a failed public tender.

Contractual Basics and Responsibilities

The administrative contract that governs the use of public space requires the winning bidder to pay an annual fee of 240 euros for a duration of four years. However, it is crucial to note that this contract does not grant the operator permission to open without the requisite licenses. Hernández emphasized that, “the contract merely regulates the use; it does not legitimize the permissions needed.”

This statement highlights a critical point: it is the concessionaire’s responsibility to obtain the necessary urban planning and operational licenses before proceeding with any construction or operation. Hernández drew an analogy to renting a private property, stating, “You may lease a space for a cafeteria, but that doesn’t automatically secure the necessary licenses from Urbanism.”

Lack of License Applications

Hernández noted a striking absence of any actions related to license applications from Urbanism between 2022 and October 2025. She stated, “From 2022 to 2025, there hasn’t been a single inquiry,” emphasizing that neither the kiosk installation nor public space occupation was communicated to Urbanism for the required permits.

This oversight came to light following a report from the Local Police, which prompted an urgent meeting with the business operator in October. In this meeting, the councilor clearly outlined the legal requirements that needed to be fulfilled and requested the necessary documentation.

Deadlines and Legal Obligations

Following the initial meeting, the town’s Contracting Department demanded, by early November, that the entrepreneur submit the obligatory documents, including the urban license for the kiosk installation and a classified activity license to function as a bar-cafeteria. Despite the deadline, no response was received, and the failure to comply with legal obligations persisted.

On December 31, the Local Police issued another report concerning an outdoor event hosted at the establishment featuring a DJ, without any security plan in place. Hernández expressed her frustration, stating, “Not only was the venue open without the necessary permits, but they also held an event.”

Legal Consequences and Precinct Action

The police report led to an intervention by the Contracting Department and a review of the case, which revealed non-compliance with the contractual and legal conditions. Consequently, on January 19, authorities proceeded to seal the establishment.

Controversy Over Facilities

When questioned about the use of chemical toilets at the venue, Hernández strongly reiterated that such facilities are not permissible for a classified bar-cafeteria. It’s worth noting that shortly before the closing, a communication regarding the start of classified activity was submitted to the Town Hall. However, this document was incomplete and deemed invalid. Hernández pointed out that this submission came at a time when it was clear that the procedure was moving forward.

Following the sealing, the entrepreneur submitted a new project for review by the technical department to determine its compliance with local planning requirements.

Public Reaction and Accusations

In the wake of the sealing, a group of supporters congregated outside the Town Hall in solidarity with the entrepreneur. The operator had previously accused the local government of harassment on social platforms, drawing parallels with the closure of the Camelot nightclub.

In response to these accusations, Hernández firmly stated, “If applying the regulations amounts to persecution, then I have nothing further to say.” She clarified that only legal measures were being applied.

Ongoing Proceedings and Regulatory Obligations

Regarding the nightclub linked to the entrepreneur, Hernández confirmed that the sanctioning process is ongoing. This was prompted by acts recorded by the police, which indicated the presence of minors and unauthorized constructions.

“An inspection documented the presence of minors and unauthorized works, which led to the initiation of legal proceedings,” she explained, emphasizing that the situation is still unfolding.

Addressing Allegations of Favoritism

Hernández also addressed criticisms regarding potential preferential treatment toward the entrepreneurs involved. She rebutted these claims, insisting that all businesses are treated equally. “I have faced personal accusations for enforcing regulations in other instances,” she declared, referring to a complaint lodged by the proprietors of El Muelle Viejo.

Striking a Balance Between Leisure and Rest

Amidst calls for more nightlife options, Hernández insisted that Puerto del Rosario must be revitalized. The local government is currently working on various initiatives to facilitate events while maintaining a balance between leisure and peace for residents. To this end, certain areas, such as the Risco Prieto industrial estate, have been designated for nightlife to prevent disturbances in residential areas.

“Finding a balance between leisure and tranquility is our objective,” Hernández reiterated, emphasizing that compliance with the law is essential.

The Impact of Public Criticism

Hernández expressed concern over the atmosphere of hostility that emerged following the sealing of the establishment. She voiced displeasure over threats directed not only at her but also at the technical staff involved in the regulatory process. “It seems unjust that we are subjected to such threats simply for doing our jobs,” she lamented, particularly regarding undue attacks on her colleagues.

The situation in Plaza Millares Sall illustrates the complexities of urban planning and business regulations, raising questions about compliance, community relations, and the balance between commercial enterprise and public interest.
