Concerns Raised by Intersindical Canaria Regarding Betancuria’s Municipal Governance

Intersindical Canaria, a prominent trade union, has recently expressed grave concerns about what it deems as “arbitrary maneuvers” by the Betancuria Town Hall. Their alarm was triggered by the municipality’s announcement to establish a working group with the SEPCA union aimed at reviewing the Relationship of Job Positions (RPT) and other labor matters within the municipal framework. This initiative has been interpreted by Intersindical Canaria as a direct contravention of existing plenary agreements and established labor rights procedures.

Context of the Relationship of Job Positions (RPT)

The current RPT was ratified in June 2024 with an absolute majority from the Town Hall’s assembly, following a collaborative negotiation process that involved both Intersindical Canaria and Comisiones Obreras, alongside active participation from municipal staff. Intersindical Canaria asserts that this document was backed by favorable technical and legal assessments, rendering any revision of it “legally unfounded” and contradictory to an ongoing plenary agreement. This rigidity in adhering to previous agreements is not merely a matter of principle for the union but is underscored by the RPT’s current scrutiny by the public prosecutor’s office.

Allegations Against Municipal Authorities

Intersindical Canaria draws specific attention to the actions of Mayor Enrique Cerdeña Méndez and the secretary-intervener Elena Puchalt Ruíz, accusing them of attempting to effectively nullify the RPT without adequate justification or appropriate reports. The union argues that such actions not only undermine the framework established by the original negotiations but also disregard the guidelines set by the Advisory Council.

Furthermore, Intersindical critiques the involvement of the SEPCA union in the negotiations, labeling it as an unmerited attempt to supplant democratically achieved agreements under the guise of modernization, which lacks the necessary technical and legal support. This move is perceived as an exclusionary tactic against the unions that played a role in shaping the original agreement, highlighting a potential erosion of labor rights for municipal employees.

Concerns Over Teleworking Practices

The union raises additional issues regarding the management of telework within the Betancuria Town Hall. According to their observations, teleworking is currently being implemented irregularly, with unclear criteria and decisions made on a discretionary basis by the mayor’s office. This has led to inconsistencies and perceived inequalities among staff members. Intersindical Canaria points out that it is contradictory to consider a review of the system when a comprehensive formal regulation ensuring transparency and equal treatment for all employees is not yet established.

Issues with Workplace Harassment Protocol

Another significant concern highlighted by Intersindical is the status of the workplace harassment protocol. Workers initiated this protocol over 18 months ago; however, it remains “stalled” without any formal investigation or action being taken, despite existing allegations against both the mayor and the secretary-intervener. The union is critical of the municipal government’s decision to announce a “new harassment protocol,” describing it as a “cosmetic” measure that fails to address the lack of action on pre-existing complaints.

A Call for Respecting Democracy and Workers’ Rights

In the wake of these developments, Intersindical Canaria has urged the Betancuria Town Hall to honor existing plenary agreements and strictly adhere to current legal frameworks. The union remains vigilant against any moves that they believe could undermine workers’ rights. Moreover, it has broadened its warning to encompass all public administrations across the island and beyond, emphasizing a commitment to defend labor rights fiercely.
